Indra1
I joined an american company as a FTE last year and got H1B petition approval for 3 years. I scheduled H1B stamping in Canada and got a date in March end 2020. I traveled to Canada with tourist visa in middle of March and immediately after that the COVID-19 lock down happened and US consulate Canada cancelled my stamping appointment. From then I am stuck in Canada, but working remotely for my employer. Now US Consulate in Canada has opened up and is taking in fresh appointments. I was able to get an appointment 3 months from now. Now my employer's immigration team is planning to file an amendment for me. I am wondering if this is necessary, as I did have a change of location, but that location is a city in Canada, which is outside the USA. So do I still need to file amendment ? Quote Link to comment
JoeF
You are on H1 by definition only when you are in the US. If you work abroad no amendment is needed. Quote Link to comment
gopalakrishnach
If you are outside USA no amendment is required. I maybe wrong. Quote Link to comment
User099
If the only reason for amendment is for the location change to Canada, then that doesn't make sense. You are not on H1 when you are not in US. Quote Link to comment
