aabcdefg
Hey guys, I worked for Company A through which I had an approved I-140 with a date of August 2014. I got laid off in 2017 by Company A and then joined Company B. Now Company B has filed PERM and is now going to file I-140. I am however looking to change jobs and am wondering what happens if the I-140 through Company B is approved and I switch jobs. Assuming I switch jobs within 180 days after I-140 approval with Company B, will Company B revoking its filed I-140 before 180 days has passed since approval mess up H-1B extension process? Basically, I just want to confirm that I am able to extend my H-1B three years at a time indefinitely since my original I-140 was approved. Thanks! Quote Link to comment
gopalakrishnach
I140 of B approved and onc eyou leave job before 180 days I feel they will revoke it. Ater 180 days they cannot. I feel once B is approved that will be your current. You cannot use A no more. Edited April 24, 2020 by gopalakrishnach Quote Link to comment
User099
When in 2017 did you get laid off by Company A? Answer to your question will depend on this. Quote Link to comment
aabcdefg
This is such a confusing response. I did mention I got laid off by Company A. Quote Link to comment
User099
When in 2017 did you get laid off by Company A? I don't know which part of this question is confusing to you. New rules for I140 came into play in mid of Jan 2017, so if you got laied off before that then you can't use 140 from Emp A. If not, you can use I140 from Emp A for future extensions. But you didn't say when, like which month. Exactly what about "When in 2017?" is confusing? That's important because the laws changed in 2017. Edited April 28, 2020 by JoeF Quote Link to comment
