MyneniAnupama Posted February 14, 2020 Report Share Posted February 14, 2020 Hi all, i got my H1B approved in July 2014 and it is valid from Sept 2014 to Sept 2017 I went to USA and worked for the company who sponsored my H1B from Dec 2014 to May 2015. Due to some personal problems i went back to india in June 2015. I heard that there is a new rule which can be used to recapture my unused time after 6 years. Can anyone who has experienced this, answer me? 1) when will my 6 year period end ? ( July 2014- july 2020) or (sept 2014- sept 2020) or ( dec2014- dec 2020) 2) Can I utilize my remaining period using cap exempt for 2 and half years ? or 5 and half years ? (assuming H1B total 6 years) 3) My previous H1B sponsor not willing to apply for me, can you suggest any employer who can apply cap exempt ? I appreciate your help. Thank you. User099 Posted February 17, 2020 Report Share Posted February 17, 2020 I don't know of any such rule that says the H1 will expire in 6 years of last use. You can use the a total of 6 years without an I140 as cap exempt. So you will have 5.5 years remaining. Quote Link to comment

You can file cap exempt even after 6 years, however you calculate. 2. five and half years 3. Depends on your skillset and company requirements. Quote Link to comment

From July 2014 to May 2015 you were on H1B so you will get remaining time getmax almost 5 years when you start H1B next time without I140. 3. Come on, you need to find a job not others for you.
