RMutnuri Posted February 13, 2020 Report Share Posted February 13, 2020 (edited) HI, I have an approved I140 from Employer 1, then I quit and did not work for 2 years for some reason; later I joined Employer 2, now can I use I140 to travel US through Employer 2 OR need to go a fresh H1B process from employer 2? If it is fresh H1B from Employer 2, does my I140 still remain active and can use it for GC. Kindly clarify the process. Thank you. I guess you can check online status of your I140 If it is still active then any employer can apply H1B outside lottery else you have to be in lottery... You need new H1B to come to USA... User099 Posted February 13, 2020 Report Share Posted February 13, 2020 I140 can't be used for travel or applying for a visa. You will have to file for a new H1 and get a visa and then travel. If your I140 was not withdrawn before Jan 2017 and was approved for more than 180 days, you can use it for filing a H1 beyond 6 years. Quote Link to comment
