H1B Tranfer while previous amendment & extension in rfe

Hi 

My 797c got expired in Oct. Current company applied extension in Aug. Received RFE and yet to respond back.

Now I got an offer from another company. My i94 is valid for another 2 years. Can the new company apply for H1B transfer even though 797 expired and RFE in progress. Also My wife's i94 already expired in Oct. What happens to her status?

If you I94 is valid, new employer can file for a transfer. 

Did you not file for your wife's H4 extension in Aug when you applied for your extension?

Can the new company apply for H1B transfer even though 797 expired and RFE in progress -- since you said My i94 is valid for another 2 years then YES

H4 is not applied along with H1B extension?. If not do as soon as you can depending on her status and I94.

H4 extension was also applied along with H1b extension
