O1 Visa & Changing jobs on I-140 (Eb-1A)

Hi Folks,

Need some guidance on my situation. Currently, i have an approved O1 Visa till Nov 2021. Concurrently, my employer applied for EB-1A and my I-140 was approved with priority date of Feb 2019. I am an Indian national and since there does not seem to be any movement in the visa priority dates for EB-1, I wanted to understand if I have the option of moving jobs to another employer. Can my O1 visa and I-140 priority dates be ported to another employer?

EB1A does not need a specific job sponsor. Hence you can change jobs on O1 and later on after getting the GC.

Follow up questions on that - does that mean that the new employer has to do an O-1 Transfer (similar to H-1B transfer) for me to be able to join them?

And then continue the I-140 when the dates become current?

He does not continue anything. If what you indicated was right, EB1A means any suitable employer. If this one is suitable, then join them on a longer basis.

You do not need a sponsor. You choose your employer.
