xyz8345 Posted October 8, 2019 Report Share Posted October 8, 2019 I stayed in US in L1 A for 6yrs and 10 mths and returned to my home country on May 2018. I had 52 days of staying outside US until that time. A petition was filed for the remaining 52 days that got approved. The petition was filed with exp. date of 12/08/2018.I did not go for stamping at that time as i was waiting for I 485 to be opened up for EB1. Unfortunately it never became current. Now, i completed by cool off period of 1 year by staying and working for the same company in my home country and i would like to use that petition and go for stamping. Can i use that and go for stamping and once arrived in US, will have our legal team apply an extension ? Quote Link to comment
pontevecchio Posted October 9, 2019 Report Share Posted October 9, 2019 Using any part of the previous allocation will reset the time frame to one more year. You could return in 2020 once the company files an L1A petition for you and gets it approved giving you potentially up to 7 more years. Quote Link to comment
