Hi,

I'm on h1B visa with approved I 140. My wife is on H4 EAD. My visa is coming up for extension and my employer does not file for H4 EAD extension and does only H1 and H4 extension.

Can I ask my employer to file for only my H1 extension and then based on ack of that H1 can i file separately for H4 and h4 EAD extension with some Attorney , or will I have to wait for H1 approval to come to file for extension.

Considering the time these days it takes for approval to come what should be the best option for me so that my wife is not without job because of waiting for EAD, Our visa and her EAD is upto April 28 2020.

Thanks,

Yogesh.

My best suggestion and some of my friends already did it recently.

Apply only for your H-1 extension in premium before 180 days. As soon as you get it approved schedule a H-4 visa interview for your wife in Mexico (Matamoros) with your new approved I-797. As soon as she comes back from Mexico apply for her H-4 EAD extension.

The above procedure is for saving lot of time with H-4 extension bio metrics.  It is taking a lot of time for receiving H-4 extension in current scenario. Also USCIS announced they are not doing premium for H-4 and H- 4 EAD anymore.

Don't think about out of country stamping cost. You are saving $500 (H-4 extension and bio metric fees) anyway. Easy and fast way.
