Traveling to Indian when h4 approval is pending

Hi everyone 👋

My h1 is approved recently for 3 year's but h4 is still pending. Can my wife travel to India and is there any chances of H4 rejection?

Also it has been more than 3 months and her H4 is still not approved. Does anyone knows h4 approval time at Nebersaka?

 

Please help if anyone has any info or in same situation

The way it works is that she can go back any time and get a H4 visa and return with your H1 petition approval. The H4 visa will be issued based on the credibility of your H1 status and since you recently got the extension approved, there seems to be no issue.

An H4 COS or EOS would get denied if the person travels abroad because there wouldn't be any status to change or extend. A person by definition only has a status while in the US.

If she travels abroad she would have to get an H4 visa, based on your H1 status, to come back to the US.
