mrajeshku
I got H1B in Oct 2015 and I traveled to US in June 2016. My Visa was about to expire in July 2018 and meanwhile in April 2018 I switched over my job and applied for Visa Transfer . My visa Transfer got rejected and I came back to India in Sep 2018. I worked in US for 2.4 Yrs and currently working in India. I would like to know if I can transfer my Visa with my current employer. My visa and stamping are expired now, please advice. NotAnAttorney
any employer new or old could file a cap-exempt petition for you. Upon approval and successful stamping you could return to US and start working. As you have only used 2.4 of 6 years cap, you still got 3.6 years of cap quota. Quote Link to comment
JoeF
A new employer can file an H1 for you at any time. When it is approved you can get a new visa. Edited July 30, 2019 by JoeF Quote Link to comment
pontevecchio
You are eligible for 3.6 years in total of non cap H1 status if a H1 sponsor will file and get a H1 petition approved for you. Quote Link to comment
