Can i go back to employer A if my employer b H1b gets rejected ? Note: Employer A has not revoked my previous H1b yet. Any reply will be appreciated. Quote Link to comment

gopalakrishnach Posted May 31, 2019 Report Share Posted May 31, 2019 If you are on good terms with employer A you can go back since you said H1B is not revoked. On the day you want to go back make sure your H1B is not revoked. Normally as per law employer are required to report to USCIS that employee no longer works for them and revoke H1B. Employer A was required BY LAW to inform USCIS that you no longer work there. That is mandatory. If they didn't inform USCIS they would have to pay you for all the time even though you didn't work for them. If they want to hire you back they have to file (and pay for) a new H1.
