Raja Yeruva Posted February 9, 2019 Report Share Posted February 9, 2019 Hi, Please help me on my questions when I travel out during H1 transfer.I have a valid visa on passport with my ex employer which isn’t revoked. What documents do I need to produce when the transfer is still pending when I return? Do I need to go for stamping after petition is approved with my new employer when am out of US having had valid visa on passport with my ex employer.Isn’t only petition good enough to enter? Also do I need to carry the original petition or copy of it at POE as there can be situation where my petition approval is just a day or two before my return and not possible to mail. What can I do do to reenter if by any chance the H1 transfer is gone to RFE or denied during my travel? Link to comment
pontevecchio Posted February 10, 2019 Report Share Posted February 10, 2019 It used to be OK to show a transfer receipt quite some time back. Now you need an approved H1 petition for the company you will work for on coming back. Any existing valid H1 Visa will do to return along with the H1 petition approval. Touch base with your employers lawyer to get the faCTS. Have them use PP and then travel after approval. Link to comment
