RC0512
Hi All, please advise. I have I-140 approved with my ex employer since 1 and a half year(so it is more than 180 days). My ex employer is going out of business in couple of months. Is that I-140 still valid? can i still use that I-140 to change employer and transfer my H1-B? please help, it's urgent to know so i can plan accordingly. Thanks, RC Link to comment
pontevecchio
It is valid till revoked. So, you can change employer. Make sure to cover your bases with a lawyer. Link to comment
RC0512
Thank you for the reply. So that means if the company goes out of business my I-140 get revoked automatically even though it got approved more than 180 days(one and half year) ago. I was in impression that i can use approved I-140 for H1-B extension and transfer until priority date does not come. Thanks again. please advise. RC Link to comment
