dv123 Posted December 31, 2018 Report Share Posted December 31, 2018 My daughter got EAD as part of my EB1 Green card process when I filed for concurrent filing of I-140 and EAD pending I-140 approval. Since my daughter turned 21, she is studying on F1 visa from past 5 months. She didn't change her status to EAD as of now. The EAD will expire in Oct 2019. Before we apply for EAD renewal, is it required to change her status to EAD from F1 visa Or is it OK to renew her EAD without changing status to EAD. University student office suggested to continue on F1 until we get actual Green Card. Kindly suggest what we have to do to renew her EAD. Regards, Link to comment
pontevecchio Posted December 31, 2018 Report Share Posted December 31, 2018 EAD is not a status. It is a benefit of ongoing AOS and one may choose not to work at all. She does not need the EAD to study . She should not leave the country till she gets the GC in hand. https://www.uscis.gov/i-765. If she has a combined EAD/AP, renew the same at the appropriate time. dv123 Posted January 1, 2019 Author Report Share Posted January 1, 2019 Thank you very much.I understand that it is not mandatory to work at all on EAD as it is AOS. since her present status of stay in US is F1 visa, when we renew her EAD in October, is it required to change her status of stay to EAD ( I mean submitting EAD card in university, so they will consider the status, but she will loose her F1 status). Or is it OK her to continue on F1 visa and parallel we can renew EAD. Kindly clarify. Regards, Link to comment
