darius Posted November 1, 2018 Report Share Posted November 1, 2018 I have a few questions with respect to an approved I140, According to current USCIS policies: - I need to wait 6 months after an approved I140 so that my application cannot be withdrawn/revoked by my company or USCIS (unless for any misconduct), so that my priority date is fixed, and so that I can also apply in future for cap-exempt H1b till my priority date is current? - For any change in position or employer in the future, I still get to keep my priority date and cap-exempt H1b from my approved I140? I will however need to file a new PERM/I-140 petition for the new position or employer whenever my application gets reviewed by USCIS - Do I still get to keep my priority date and cap-exempt H1b in future for a different company if for some reason my previous company with whom I have my I-140 approved shuts down in the future ? That does not affect your Future H1 extensions if the I-140 has been pending more than 180 days. 2. You will need the sponsor to file PERM etc., if you intend to change employers. 3. Usually.
