kunal_djscoe
Hello, My I140/!485 concurrent filing in EB1 category ( India) was recently rejected. Just saw the status update not received official reason/notice of rejection. I was currently on O-Visa with the stamp in my passport expired but my I-797 is valid till end of the year. My question: Is my O-Visa still valid? Can I continue working on O-Visa and file a new extension for the same? Do, I need to leave the country and come back to get a stamp? Or, Do I need to leave the country right away? I will greatly appreciate a swift response as I might be pressed for time. Link to comment
kunal_djscoe
Forgot to add. I had applied for EAD as well with the application. Link to comment
pontevecchio
A visa is an entry foil/stamp in your passport. If you have an O I94 valid till year end, you can stay if you are maintaining valid O status. Did you have a lawyer involved in your GC filing? Link to comment
JoeF
What matters is the end date on the I-94. You remain in whatever status is listed on the I-94 until its expiration date. Link to comment
