Kris01 Posted September 25, 2018 Report Share Posted September 25, 2018 I was working in US and my previous employer had filed my I140 under EB3. I came back to India in 2000. I am currently in India and when I checked my I140 status in USCIS web site recently it says my I140 was approved in February 2001 and the case status is "Post Decision Activity". My priority date (PD) is February 2001. I would like to mention here that my previous company which filed my I140 doesn't exist any more. I have got a job offer from a Company in US. Can they use my old approved I140 Priority date and carry forward my GC process? What are my options? Please Advise I would appreciate if any body can answer my query and give feeback ASAP. It is possible you may be able to retain the PD and I say may. In that case you are able to get an employer filing a concurrent petition for you. Link to comment
