rishikeshhere Posted September 13, 2018 Report Share Posted September 13, 2018 I worked with my employer on H1b from 2011 to 2015 and then switched to H4 In 2016 the same employer filed my i140 and got it approved I have not been working since 2015 due to personal reasons and now the same employer is willing to file change of status for me from H4 to H1 Since i didn't work for the employer after the i140 got approved... can they file my h1b based on the approved i140?
