I 94 Status

I have applied 2nd h1b extension under premium processing and it got approved while first  h1b extension is still under initial review (applied in regular for the same employer, same client but different wage and job level)

 

i-94 Expiration’s Date : 03/04/2018

 

1st H1B extension:

Type : Regular

Receipt Date : 10/05/2017

RFE : NO

Status : Initial Review

 

 

2nd H1B extension :

Type : Premium

Receipt Date : 08/16/2018

RFE : NO

i-94 Date : 08/16/2018 to 07/29/2021 

Status : Approved

 

 

I -94 expiration days from 03/04/2018 to 08/16/2018 :  165 days(from the time precious i94 expires to start of new i94

My employer said i am good with the 2nd h1b and they are going to withdraw my first h1b extension. 

 

I still have few questions about my legal stay. Could you please clarify?

 

1) Do i need to go out of country for stamping ??As there is gap between end date of previous i94 to start of new i94?? (03/04/2018 to 08/16/2018)

 

2) Am i out of status between 03/04/2018 to 08/16/2018 or am i  good to work ?

 

3) is it safe to withdraw initial when there is gap between i94’s? What should be my action of course?

The fact that the extension came with an I94 keeps you legal. Why would you not trust your company? You have no role in any further action.
