DivB Posted August 21, 2018 Report Share Posted August 21, 2018 Looking for help in this situation pls!! Lost job on Apr 4 2018 and have not got any job till date. H1b grace period was over in June and I've been staying here in US. I have valid i 94 til Jan 2019 and plan to goto India for H4 next week. I have not stayed beyond 180 days after layoff and will leave before I hit the 180 day mark. 1. Will my out of status stay ~ 3 months after the 60 day grace period impact my chances of getting H4 . pontevecchio Posted August 28, 2018 Report Share Posted August 28, 2018 It should not. But they may ask why you did not file a COS TO H4, once the 60 days were up. They should still give you the visa if the person in H1 is in valid H1 status. Link to comment
