Sandeep Agarwal Posted July 7, 2018 Report Share Posted July 7, 2018 Hi, I traveled to India in Nov 2016 when my H1B Visa was expiring on 15 Dec 2016. My extension application was pending. On arrival to the US on 5 Dec 2016 I got the I-94 until 15 Dec 2016 (for 10 days only) since I didnt have the new 797 yet. In Apr 2017 my extension was approved and I was issued a new 797 with a I-94 at the bottom valid from 16 Dec 2016 to 31 Mar 2019. I am planning to travel to Canada soon, will the I-94 attached on my 797 be considered valid for the purpose of AVR or do I need to get a new visa stamp? Link to comment

Thanks for the reply. That's my confusion. Since my I-94 which I received after landing has expired, my I-94 on the extension I-797 will be the valid I-94, right? So for AVR I will show my I-797 as a proof of my I-94? Link to comment
