Ruready812
A brief description of the situation: I was with Employer A with H1B visa valid from 2016 to 2019. I applied for an H1B transfer and joined Employer B as soon as I had the received receipt. The H1B transfer to Employer B was denied by May 4, 2018. Now, I have an employer C who is willing to file an H1B transfer for me. My current H1B visa stamping with Employer A is until 2019 Jan and my I94 is also valid until Jan 2019. Questions : Q1) Employer C is in the process of filing H1B Transfer Consular Processing (Premium Processing), Do I need to go out to get stamping again? Q2) If Stamping is necessary, Can I do it in Canada, DR or Mexico? Q3) Am I eligible for a stay in the US until then? Hoping to hear back from you soon. As I have already lapsed 30 days, it would be really helpful if we can expedite the process. Please find all the attachments in the email. Link to comment
Tjgarla
If it is consular processing you can't legally stay in the country. You need to go out and get it stamped once approved. Link to comment
pontevecchio
You only need travel and return using the same visa. You do not need a new H1 visa. Link to comment
