who take this decision for cspa eligibility .nvc or visa officer at the time of interview . i have een many case where derivative applicants got refusal for age out and in some case age out applicants got visa .. what is all this > does any fixed rule for cspa . why nvc ask to file ds 260 and pay fee if they wont give visa in age out applicants .is this kind of cheating with applicants . no fixed rules i guess . i have a list of 10-12 applicants where they got refusal and at the same time i know few guys those who get the visa in same age out issues ..

USCIS decides applicability. The rules are specific and one either qualifies or one does not. It is scurrilous to make baseless claims about cheating in this context. What exactly is your locus standi in this matter?. Having said that CSPA can become complicated and those who seek to save a little money on a lawyer to guide them in the process are being penny wise and pound foolish.
