J2 to H4 to E3 visa change

My husband was subject to INA 212 (e) as he trained on J-1 (I was on J-2). Now he has his Conrad 30 visa waiver application approved (he will be working in an underserved area for 3 years), changed his visa to H-1 and I changed to H-4. Since his Conrad 30 waiver app is approved, can I change from H4 to E3 (instead of waiting for him to finish 3 years) right or can I not do it for 3 years?

I am an Australian citizen.

I would suspect that you cannot do this for 3 years. But no harm in discussing the matter with a lawyer to get the official version.
