gadeepu Posted December 22, 2017 Report Share Posted December 22, 2017 Hello friends, My mother's visitor visa I-94 will be expiring in Dec 27th 2017. We applied for the extension around 10 days back and received a notification from USCIS that the application is received and not yet pending. Case status has not yet been updated in the USCIS website. However, I received the application acceptance confirmation notice thru email. She has a valid visa until December 2018. My father passed away around 8 months back. My mom wanted to stay with us for few more months. Hence, applied for extension at the last moment. Kindly let me know: 1> Is it legal to stay in USA with the extension application accepted (not even pending) with an expired I-94. 2> How does future visitor visa application or Green Card application will get affected if the extension application gets denied and she leaves immediately after the decision? pontevecchio Posted December 22, 2017 Report Share Posted December 22, 2017 Nowadays they are very strict and the extension may not be granted. If she overstays the existing I94, her visa is rendered invalid. Best practice is to have her leave and return in 2019 after renewing her visa. Link to comment
