Amit07 Posted October 4, 2017 Report Share Posted October 4, 2017 I am in the process of obtaining my green card through employment (EB3). My I140 is approved and I485 is still pending. I got married and my spouse is in India. It is my understanding that as long as my I485 is pending and I get married I can file for following to join through consular processing. Is this correct? Also can I file while form I824 when my I485 is pending or do I have to file it after my approval? Also is there a time limit for filling following to join once i obtain my I485 approval? JoeF Posted October 5, 2017 Report Share Posted October 5, 2017 The reason Ponte is asking is that if you are in H1 status, your spouse can get an H4, enter with that, and file an I-485 once in the US, if your PD is current. That would make things easier. Link to comment
