shiva81 Posted February 6, 2017 Report Share Posted February 6, 2017 I am in 11th year of my H1B. I have approved I-140 with PD of Jul 2010. I'm in EB2 Category. I feel its been a long wait fora GC. I just want to know if I can leave for Canada temporarily and come back on H1B when the filing dates for GC become current. If I do will the employer then file for an extension as I have approved I-140 or Do they have to file for a new H1b petition which is subject to CAP? please help. Link to comment

pontevecchio Posted February 17, 2017 Report Share Posted February 17, 2017 If you have a chance of becoming a Canadian PR and then Citizen, you should take it. If the employer is agreeable you can return when the dates are current. Link to comment
