H1 Visa (Need to go to India on Family emergency)

Hi all..

Can someone please help me with the following questions.

I have a valid H1B and H1B visa till 9/30/2019. Due to some family emergency , i need to go to india and stay there for 6 months.

Can i come back to USA with the H1B visa that i have? Do my H1B gets invalidated as i going to take leave for long time.

If i can enter, Do i need to find a job while returning to USA or Is it possible that i can reenter without a job?

Do i need to keep running the payroll even when i am at India on vacation?

Your H1 status is immaterial outside the country. "Running" payroll would seem illegal. You are allowed to work for them in India should you choose. You can return on the H1 visa only if you have a approved H1 petition for the employer you are coming over to join and make sure all documents needed are with you.

Sure you can come back with out any issues unless your H1 B is revoked by your employer. You already have a job thats why you got H1 and H1 Visa. At POE all they care about is your employer. I know people who came back even after 1 year with a valid visa. Payroll is not needed.
