Rambhatla1205
A) For a H1B-H4 change of status, how many pay stubs are required?(is it 2-3 recent most pay stubs(bi-weekly pay) or recent most 2-3 MONTHS pay stubs?) B) Currently am on my H1 B visa status. My husband H1 B is getting expired by August 1st week and their company is preparing documentation for his H1B extension. However due to their company policy, they are required to file the extension only under REGULAR processing..(not letting my husband to pay for the premium processing fee as well as company not paying for the premium processing as there is no urgent requirement of travelling outside the country on business) what are the best options for me to change my status from H1B to H4? 1) to go India and get stamped on H4 visa? would there be any kind of question at the embassy as my husband H1 B is left with only few months.? Also, would there by any question at the port of entry? 2) As my husband's H1 B extension is under regular processing, am concerned if I apply my H1B- H4 COS and EAD, that how many months it would take for the approval/decision. In a situation if he has to travel outside the country, company is ready to do a premium or explore other options for his H1 B...what happens about my H4 COS & EAD? 3) Once my H1B-H4 COS is applied, can I travel outside the country? pontevecchio
You can leave and return with a H4 visa and then file extension beyond August based on his application. If there is a problem with your payroll then leave and return with a H4 visa. Link to comment
