My employer will most likely file for an extension some time close to expiration so that it is approved in late December 2015. I plan to travel to India in Oct/Nov for a family reunion. My current visa expired on 5th Dec 2014 so I have to go for re-stamping when I am in India. Can there be an issue when I go for stamping because my H-1 petition will only be valid for another 2-3 months? Ideally, how much time should be left on H-1 petition for visa stamping? Since my employer is the same and since I will be going for visa renewal within 12 months of previous visa expiry, looks like I will qualify for Interview Waiver Program. Does that change anything? shekar11# Posted March 4, 2015 Report Share Posted March 4, 2015 Try to get an extension and go with your new I-797 so that you get the stamping done for another 3 years. You can apply for H-1 extension 180 days before your current I-797 expires. You will avoid 1 extra trip to consulate in future. Link to comment
