Travel to India Using AP - H4 status

Recommended Posts

Hello

I have my EAD/AP combo card. My I-485 application still pending with USCIS (as part of my spouse's employment based EB1 application). . I am planning to travel to India in June and return in July (using AP to re-enter). I have H4 paper until Feb 2018 (H4 VISA expired).

Please help me with the questions/doubts.

1. Is it advisable to travel using AP?

2. What are the additional documents i need to show when i re-enter USA?

2. Is there will be any difficulties to re-enter using AP. I am traveling with two of my kids (they have US Passport).

3. Is there will be secondary inspection ?

Thanks and your help/suggestions are greatly appreciated.

1. You can certainly  use AP to travel.

2. Advance Parole and Passport.

3. AP is by order of the Attorney General and hence there will be no "difficulties".

4. Most Likely as it is your first use of AP. It only means being sent to another room where a more senior Officer will parole you in.

H4 paper means nothing and has no significance. If you wanted to enter in H4 sttus you would need a H4 visa based on your spouses valid H1 status.
