rahul1108 Posted May 8, 2017 Report Share Posted May 8, 2017 Hi, My I-94 expired on May 1st 2017 while my employer has filed for an extension under normal processing(as PP is stopped now). Now i got an offer from employer B for a full time position. Can employer B transferred my H1b even after my i-94 has expired or i have to wait till my petition gets approved? Link to comment
smim Posted May 10, 2017 Report Share Posted May 10, 2017 Hello rahul1108, i was doing some research on this scenario. What i found is, it is better to wait until your current extension is approved. As the transfer is dependent on the current extension. If the extension is denied/revoked after you join the new employer you will be out of status for some time. So it is always good to have a valid I94 before trying to switch companies. Experts here can add more if needed. Link to comment
pontevecchio Posted May 10, 2017 Report Share Posted May 10, 2017 You have to wait for the decision on the petition by B and if it comes as approved before the current extension is approved ,you will need to leave and return with the H1 visa to work for B. Link to comment
