I-140 is approved can I quit my job and Stay in India for 6 months

Hi,

 

I have a question. Can someone please clarify?

 

I  am into 7th year in my h1 and I have an extension for h1 till 2019 and also I have a valid h1b visa till 2019. My I-140 is also approved. My question is:

 

     - What if I quit my Employer A and goto India for 6 months and my employer A has withdrawn the h1b Petition but I still have a I-140 Approval.

 

     - Can Employer B apply for a new H1b petition as soon as I am ready to come back to the US or will they have to wait for h1b CAP and Apply only during APR when the slot opens?

You can get H1 extensions as long as the I-140 is not revoked .

You will need to find a job with new employer, get the visa extension done with the new employer, get your visa stamped and then travel to US.
