pyadav7573
Hi, I appeared for my H1B visa interview on 25th July, 2016 at New Delhi US Consulate and the VO had rejected my H1B visa and returned back my passport and my H1B petition. The VO did not give me any other form (like 221(g) etc.). So now I want to understand is my H1B petition still valid to go for another visa stamping appointment or do i have to wait to hear back from consulate , i checked on CEAC site and it just says that visa is refused i am really confused about the status of my H1B Petition now ? Let me know if you need any further details to help me in knowing what is the next step. Request you to please respond as soon as possible as i have to resume my job in USA as i only came for 4 weeks of vacation. Thanks & Regards, Priya Yadav Link to comment

pyadav7573
Yes, mine is a consulting firm. Can anybody please help me with further steps? Following are the questions asked: Were you on L visa before and then converted into H visa? Are you still working in the US? What is the current salary your making? Where were you working previously and for how long? When was your H visa filed? Asked the old petition. what salary were you making in your previous company? Why did you accept the offer with less salary package? - When did your EAD expire? - Provided the EAD copy. How did you stay in US after the expiration of L visa? - Where does your husband work? - Asked for extension petition copy but I was not carrying it. Regards, Priya Yadav Link to comment
rahul412
So you moved from L1 to H1 to work for consulting firm. That's the issue. Next time find a real employer, not a shady consulting firm. Link to comment
madh1b
@rahul412, Why I always see issue of having an consultant is in issue. It is only issue when you violate H1b rules. So rather than always giving or using cursing to consultant, please focus on member issue and individual violation. Hope I have made myself clear. Thanks Link to comment

pontevecchio
You can go back to L2 status by getting a L2 visa and returning if your spouse is in L1 status. Link to comment
