H4 EAD questions: I-140 revoked

I have been in US for more than 10 years. My previous employer had filed my GC in 2008 (EB3) and my I-140 was approved. In 2014, I quit that job and joined another company (H1 extension based on I-140 approval). Once I left my prior company, they revoked my I-140. My current employer is filing for PERM next month.

When do you think I will be eligible to apply for H4 EAD for my wife. Would it be next month after PERM is filed or should I wait longer.

You would need an approved I-140.

The old one is gone.

i dont think PERM approval will help. 

 

PERM pending for more than 1 year or I140 approved are eligible for H4 ead.

if your I140 is revoked then there is no way you can apply for H4 EAD.. 

 

The only thing you can do is you can port the old Priority date until unless the revoke I140 was not subjected to Fraud.
