rsaiprasad.08 Posted February 4, 2016 Report Share Posted February 4, 2016 My wife got RFE on I-140 saying her university is not accredited when she completed her masters. She got letters from university saying the course work was same before and after accreditation and submitted it as RFE response. However, I-140 was denied today. She has 3 and half years experience in India and 5 years experience in US (for same company which applied GC now). Is it possible to convert to EB3, instead of EB2? The problem is that the employer applied PERM saying MS degree is required for this position. Are there any other ways to save the priority date? Link to comment
JoeF Posted February 4, 2016 Report Share Posted February 4, 2016 If the institution wasn't accredited the degree can not be used. It is THAT simple. Some letter from the university is irrelevant. Accreditation is what matters. The PD is gone. Link to comment

Attorney_15 Posted February 7, 2016 Report Share Posted February 7, 2016 Unfortunately, in these situations there really isn't anything to do to salvage the case. Even evaluators will usually not touch the education from unaccredited schools. Generally, if the degree is awarded by an unaccredited school, USCIS does not treat it the same. Link to comment
