H4 EAD Spouse Clarification

Hi Guyz,

 

With I-140  approved and PD in mid 2012. I am planning to apply for H4 EAD (spouse) this year. My situation might be a familiar face in the forum as to many here, my employer is refusing to share the copy of the I-140 or any documents related to that. But what he is willing to do is, to file the petition on behalf of me/spouse. 

He had the I-765 filled with his company name on the person preparing the application. Does that mean that she will be a part the company that files her petition or is it someone/company is just filing the petition and she still stays as a individual employee.

 

I dont want her to be a part of my company and get stuck here like i am . Please advise.. Has anybody done this way? Is there anything specific that i need to be aware of.
