Can you let me know if it is feasible. If yes, how. Some consultancies say that there is 4 days gap and I may need to go back to my home country and come back again. What are the options do I have. jairichi Posted January 5, 2016 Report Share Posted January 5, 2016 Yes, an employer can file a cap subject H1B petition in April and if approved you move to H1B status from 1st Oct. To cover those 4 days you can apply for a COS to B2 and withdraw the petition once you move to H1B status from Oct 1st. Link to comment
