RBS_123 Posted October 26, 2015 Report Share Posted October 26, 2015 Hi My Spouse was in H4 visa status. In 2013, applied for H1B and now her status is H1B. She is working since then and has a valid H1B and approved I-140. She didn't leave US since 2013 so her passport doesn't have a stamped H1B visa. I was in India so got my H4 visa stamped and now in US. Since it was fresh H1B for my wife, I don't have I 539 at this point of time. Extension is due on Sept 2016. I hope I can still apply for H4 EAD with my H4 Visa stamped pages, My wife's H1B, approved I140. Please do let me know if any issue. Link to comment
