My 6th year h1b term expire in january 2017. my company is yet to file the PERM due to layoff issues. Kindly help to clarify below questions in this regard. 1) By when should company file PERM based on my current situation. 2) if suppose PERM filing is done by company after jan 2016 , will this cause any issues ? 3) what would happen if company layoff employees with similar job title before my PERM gets approved. how would it impact ? 4) what are the extra legal procedures/loop holes to expedite PERM filing and have I-140 in hand before 6 year term expiry and if the approval is mandatory before 6 year term expiry? 5) under what situation should we travel out of US and re-enter ? kindly advise.. regards, m Link to comment
jairichi Posted September 27, 2015 Report Share Posted September 27, 2015 1. At least one year before H1B max out date. 2. No issue. You will need to leave US and can only enter US after I-140 approval. 3. PERM will be denied. 4. Approved PERM gives you 1 year extension only if filed within 365 days of H1B extension date. Approved I-140 gives you 3 year extensions. Link to comment
