Sag1984 Posted August 11, 2015 Report Share Posted August 11, 2015 Hi , H1B - Mar 2016 I was working with Company A and my PERM was submitted in May 2014. My H1B petition had end date as Mar 31 2016. I had to quit the company A and joined the new Company B in Oct 2014. H1B transfer was done and petition is active till Mar 31 2016. I went to India in May 2015 for vacation and got my H1b visa stamped for my current employer B. Company B is working on my PERM filing and the tentative filing date is Oct. 2015.(which will be less than 1 year and I might need to travel outside US to recapture time for H1 extension) Recently, I checked Company A PERM and it got CERTIFIED as of Apr 2015. Can I join my previous company A as RE-HIRE and continue with certified PERM and raise I-140? Does the H1B petition with my previous company A can be used for Re-hire? or should it require a new H1B? Please let me know my options to legally enter my previous company A? Link to comment
