absh Posted November 20, 2014 Report Share Posted November 20, 2014 hi, My case is like this. I have issued H1 B visa in 2013 by Emp A. Did not send me to USA as of today. Planning to change the company to Emp B as he is willing to Transfer the Petition. 1) What would be the case if Petition filed by Emp B gets Denied/Rejected. 2) Can I come back to Emp A and travel to USA with the Visa already issued. Request you please provide me the suggestions as I am thinking taking risk in this case, because I heard the Petition Approval is based on Emp B Reputation with USCIS. Thanks, Link to comment

In continuation to my second question, If EMP A revokes my Original petition, Can he again file the new Petition for me after I come back from Emp B Can I Travel with the existing Visa or should I go for Visa stamping again. Thanks, Yes, as long as you do not reach the max allowed stay of 6 years on H1B. If your visa is valid you can travel with that and valid employer's I797. Link to comment
