rajender17 Posted October 30, 2014 Report Share Posted October 30, 2014 Dear Sir I have H1B petition approved in 2013 and valid till Sep 2015 but it was rejected by US Embassy due to employer inability as it was a startup company and case was sent back to USCIS. My petition is revoked by USCIS in Sep 2014. Now can i transfer my same H1 petition to another employer as validity date is till Sep 2015. Thanks Rajender Link to comment

Please read again below my case and let me know 1. Applied for H1B in 2012 2. Got H1B Approval in 2013 and petition is valid till Sep 2015 3. in May 2013 US Embassy in India issued letter 221g during stamping . 4, In June 2013 and US Embassy sent a letter saying Visa cannot be issued due to employer inability. 5. My Case was sent back to USCIS. 6. In Sep 2014 H1B is revoked. Now please if it is rejected by embassy then still it can be transferred. If yes, then i will try from other employer.
