veeus18 Posted August 25, 2014 Report Share Posted August 25, 2014 Does anyone know if it is safe to travel once J1 waiver is obtained and while H1 is in process.? I am waiting for final waiver from USCIS (DOS favorable recco sent August 1). After I receive that, my employer will file for H1 (no-cap), premium processing. However, once I receive the waiver, would it be okay to go to India during that time, are there any concerns? My J-1 ends in 6 days and I need to stop working starting next week. Thanks. jairichi Posted August 25, 2014 Report Share Posted August 25, 2014 You can travel. But, if your employer files H1B petition as COS then the COS part gets abandoned due to your travel. You will need to enter US with a valid H1B visa and I797. Link to comment
