They told me that they will sponsor my H1B for next year. But what can I do since my OPT expires on February 2015 but the USCIS starts taking the application process on April 2015. This daycare is not cap exempt. I would like to know what are my options to remain in legal status from February until I get to know if my H1B gets pricked up or not? jairichi Posted June 20, 2014 Report Share Posted June 20, 2014 You have 60 days of grace period to exit US from the last day of your OPT. I believe if a H1B petition is filed within this grace period then you can apply for cap gap. Wait for others opinion. Link to comment

t75 Posted June 20, 2014 Report Share Posted June 20, 2014 If the position requires a degree in education, it can file next April. No matter what, you have to leave when your OPT is over since the is no reasonable way for you to remain in a legal status until Oct 2015. Link to comment
