Option 1) Is it possible for her to apply for L2 EAD from India? As I see that one of the requirements is I-94. But is not having a valid I-94.But she came to US 3 years back. Can she give that old I-94 (expired) and apply from India?Option 2) If above is not possible (which I believe so but wanted a confirmation),is it possible is she comes to US for 2-3 weeks and apply for L2 EAD and go back to India.So at the time of applying she will have all the documents as I-94, etc.EAD generally takes few weeks and during processing she won't be there in US.Once she gets EAD, then she can come to US.Please let me know if any one of these options is possible?Thanks in advance. Attorney_23 Posted February 5, 2014 Report Share Posted February 5, 2014 A foreign national must typically be in the United States to apply for an EAD. Leaving the U.S. while the application is processing would not typically impact the pending EAD application. Link to comment
