H1B - Reopening an earlier Petition

Hi,

My friend had applied for H1B in the year 2013 quota. However, he did not get selected in the lottery.

 

He had applied for H1B in 2008. However his consulting firm got an rfe and they could never reply to the rfe. His current consultant, who applied this year (2013) has said that he can re-open the EAC of 2008.

 

My question is that is this possible?

No. That old H1 got denied long ago when the company didn't reply to the RFE.
