H1 transfer based on I-140

My I-140 is approved from Employer A and he didn't provide me that I-140.

 

Employer B applied for H1 transfer and requested 3 years of H1 validity based on Employer A's I-140 but USCIS didn't approve it for 3 years and they just approved it based my max out date (6 years) which is until 11/14/2013 which left me just 5 more months.

 

Employer B's attorney saying, he has written to USCIS premium processing unit to request that they pull the old I-140 file and reconsider the decision (H1 end date). 

 

I have applied FOIA request (Email) but as per current queue, it might take 6 more months which concerns me. 

 

Anyone has this kind of situation? or if you have any sort of info, please let me know. 

 

My only concern is, Does USCIS considers these kind of requests ??
