simplydeb Posted June 24, 2013 Report Share Posted June 24, 2013 My wife had H1b visa with validity from Oct 2011 to Sep 2014. She worked on that H1b visa from Oct 2011 till Jan 2013. Then her project ended and she transferred to H4 visa on Jan 2013.Now she has got a job offer and an employer is willing to do the new H1b filing. How soon can she start working? Can she join work as soon as her H1b receipt is generated? Or does she have to wait for the H1b to be approved before she can work? Link to comment
bedardi_visa Posted June 24, 2013 Report Share Posted June 24, 2013 Since she has transferred to H4 visa, she has to wait till the approval comes and she cannot join just on receipt number. Although, as you may be for sure aware that premium processing will take only 2 weeks, so its just matter of 2 weeks to wait :) Best of luck! Link to comment

When did you (simplydeb) submit the change non-immigrant status application (I-539)? After the project ended on January 2013 or prior to that.
