I am currently on OPT extension and working as a full time employee. My employer has applied for a H1B on which I have  received an RFE stating that "Unrelated Degree"( Did my masters in US in electrical and currently working in IT). My problem is that my OPT extension is going to expire on JUL 20 and the dead line to reply for the RFE is Jul 24. My employer stated that they are planning to reply to USCIS on Jul 15 and upgrade my application to premium. I know I can get a cap-gap till the decision is made on H1, but if at all I receive a decision not in my favor after JUL 20(OPT ext expiry date) what would be my options.

 

  1. Do I have to leave the US as soon as the decision is made ?
  2. Can I apply for a university again?
  3. Even if I get an admit should I go out of US get stamped and comeback or can I get into school directly?

If rejected, you have to leave US. Joining some school won't help you out.
